This\u00a0decision was\u00a0reached after the <strong><a href=\"http:\/\/acluhi.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">American Civil Liberties Union (ACLU)<\/a><\/strong> and the <strong>State of Hawaii<\/strong> <a href=\"http:\/\/acluhi.org\/2016\/03\/29\/aclu-state-of-hawaii-settle-dispute-over-first-amendment-right-to-take-photographs-in-public\/\" target=\"_blank\" rel=\"noopener noreferrer\">reached an agreement\u00a0the <strong>First Amendment<\/strong><\/a> matter after a photographer was cited by a state sheriff after photographing aircraft from the sidewalk along Lagoon Drive.<\/p>\n<p>The ACLU released <strong><a href=\"http:\/\/acluhi.org\/2016\/03\/29\/aclu-state-of-hawaii-settle-dispute-over-first-amendment-right-to-take-photographs-in-public\/\" target=\"_blank\" rel=\"noopener noreferrer\">a press release<\/a>\u00a0<\/strong>which reads in part:<\/p>\n<blockquote><p>The First Amendment right of individuals to take photographs in public was re-affirmed in an agreement reached between the ACLU of Hawaii Foundation (ACLU) and the State of Hawaii.\u00a0The dispute arose when an amateur photographer was cited by a state Sheriff for taking pictures of airplanes from a public sidewalk along Lagoon Drive (near the Honolulu International Airport) without a permit. According to the ACLU, no permit is needed for this public area frequented by joggers, tourists, aircraft enthusiasts, and other amateur photographers.<\/p><\/blockquote>\n<p>The agreement\u00a0reinforces the <strong><a href=\"http:\/\/acluhi.org\/first-amendment-toolkit\/#document\" target=\"_blank\" rel=\"noopener noreferrer\">public&#8217;s right to document<\/a><\/strong> public and law enforcement encounters.<\/p>\n<p>The <strong><a href=\"http:\/\/hnlrarebirds.blogspot.com\/p\/spotting.html\" target=\"_blank\" rel=\"noopener noreferrer\">Lagoon Drive area is a popular location<\/a><\/strong> for photographers to take pictures of aircraft. There are obstacles in the area like lack of parking and a high fence surrounding the end of the drive. Other locations around <strong>Honolulu International Airport<\/strong> have their own share of issues including glass in terminal areas (glare) and no parking along Elliot Street.<\/p>\n<p>The state&#8217;s agreement to not infringe on First Amendment rights should\u00a0apply to all airports in Hawaii.<\/p>\n<p>As a photographer, <strong><a href=\"https:\/\/flic.kr\/s\/aHsiTuGw4G\" target=\"_blank\" rel=\"noopener noreferrer\">I like to take pictures of aircraft<\/a><\/strong>.
